Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the VeggieBasket mobile application or visiting veggiebasket.store (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by MCK Enterprises, a registered Micro Enterprise under the Government of India's MSME scheme (Udyam Registration Number: UDYAM-RJ-**-*****28).

If you do not agree to these Terms, you must not use our Service. These Terms apply to all users of the Service, including browsers, customers, and contributors of content.

2. Description of Service

VeggieBasket is an online grocery delivery platform that connects customers with local grocery stores for the delivery of fresh vegetables, fruits, dairy products, drinks, snacks, and other grocery items.

We act as an intermediary platform. Orders placed through VeggieBasket are fulfilled by registered local store partners. MCK Enterprises is responsible for the platform, technology, and customer experience, while delivery is carried out by local store partners.

3. Eligibility

You must be at least 18 years of age to use our Service. By using VeggieBasket, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

Our Service is currently available only in select PIN codes in India where a registered VeggieBasket store partner is present. You will be notified if our Service is unavailable in your area.

4. Account Registration

To use VeggieBasket, you must create an account using your mobile phone number via OTP (One-Time Password) verification, or optionally via email and password. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials secure and not share them with any third party.
• Notify us immediately at contactveggiebasket@gmail.com if you suspect any unauthorised use of your account.
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Placing Orders

When you place an order through VeggieBasket:

• You confirm that the delivery address and contact details provided are accurate.
• Orders are accepted subject to availability of products and a registered store in your delivery area.
• We reserve the right to cancel any order if the requested items are unavailable or the delivery area is not serviceable.
• Order acceptance is confirmed when the assigned store begins processing your order.
• VeggieBasket currently operates between 7:00 AM and 11:30 PM daily. Orders outside these hours will not be processed.

6. Pricing and Payment

All prices displayed in the VeggieBasket app are in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice.

VeggieBasket currently supports Cash on Delivery (COD) as the sole payment method. Payment is collected at the time of delivery by the assigned store partner.

Additional charges may apply including platform fees, handling fees, and delivery fees where applicable. These will be clearly displayed at the time of checkout before you place your order.

7. Delivery

Delivery is carried out by local store partners assigned to your order based on your location or PIN code. Estimated delivery times are indicative and may vary depending on store availability, order volume, and your location.

• You must be available at the delivery address at the time of delivery.
• If delivery cannot be completed due to your absence or incorrect address, we will attempt to contact you on the registered mobile number.
• VeggieBasket is not liable for delays caused by factors beyond our control including weather, traffic, or force majeure events.

8. Promotions, Coupons, and Referral Program

VeggieBasket may offer promotional coupons and a referral reward program subject to the following conditions:

• Promotional coupon VEGGIE100 provides ₹100 off on orders where the value of vegetables and fruits combined is ₹200 or more.
• Coupons are valid for one use per device and cannot be transferred or exchanged for cash.
• Referral rewards are credited to the referring user when the referred user places their first eligible order.
• VeggieBasket reserves the right to modify, suspend, or terminate any promotional offer at any time without prior notice.
• Any misuse or fraudulent use of coupons or referral rewards will result in account suspension.

9. Cancellations and Refunds

Our cancellation and refund policy is detailed in our Refund & Cancellation Policy. Key points:

• Orders may be cancelled before they are accepted by the store.
• Refunds are applicable for damaged, wrong, or missing items reported within 24 hours of delivery.
• Since VeggieBasket operates on COD, refunds are processed as replacements or account credits.

10. User Conduct

By using VeggieBasket, you agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Submit false, misleading, or fraudulent information including delivery addresses.
• Abuse, harass, or threaten any store partner, delivery person, or VeggieBasket staff.
• Attempt to gain unauthorised access to any part of our systems or another user's account.
• Use any automated means to access the Service without our express written permission.
• Misuse promotional offers, coupons, or referral rewards through fraudulent means.

Violation of these conduct rules may result in immediate suspension or termination of your account.

11. Intellectual Property

All content on the VeggieBasket application and website, including but not limited to the VeggieBasket name, logo, design, text, graphics, and software, is the property of MCK Enterprises and is protected under applicable Indian intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content from our Service without our express written permission.

12. Limitation of Liability

To the maximum extent permitted by applicable law, MCK Enterprises and VeggieBasket shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Loss or damage to goods after delivery has been completed.
• Delays or failures in delivery caused by circumstances beyond our reasonable control.
• The quality of products sourced and delivered by local store partners, beyond what is covered by our refund policy.

Our total liability to you for any claim arising from the use of VeggieBasket shall not exceed the value of the specific order in dispute.

13. Privacy

Your use of VeggieBasket is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

14. Modifications to Terms

MCK Enterprises reserves the right to modify these Terms of Service at any time. Changes will be effective from the date of publication on this page. We will update the "Last Updated" date at the top of this page when changes are made.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

15. Termination

MCK Enterprises reserves the right to suspend or terminate your access to VeggieBasket at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, our store partners, or our business.

You may terminate your account at any time by contacting us at contactveggiebasket@gmail.com with a deletion request. See our Data Deletion page for full instructions.

16. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India.
